{"id":10256,"date":"2019-01-06T09:00:25","date_gmt":"2019-01-06T17:00:25","guid":{"rendered":"https:\/\/www.privateinternetaccess.com\/blog\/?p=10256"},"modified":"2024-01-25T02:05:24","modified_gmt":"2024-01-25T10:05:24","slug":"hard-to-prove-harm-google-wins-lawsuit-over-facial-recognition","status":"publish","type":"post","link":"https:\/\/www.privateinternetaccess.com\/blog\/hard-to-prove-harm-google-wins-lawsuit-over-facial-recognition\/","title":{"rendered":"Hard to prove harm: Google wins lawsuit over facial recognition"},"content":{"rendered":"<p>As new privacy laws attempt to address the different ways that companies collect, store and use biometric data, it\u2019s also important to keep an eye on how the courts are interpreting and applying legislation.<\/p>\n<p>In a <a href=\"https:\/\/www.courtlistener.com\/docket\/4263531\/rivera-v-google-inc\/\" target=\"_blank\" rel=\"noopener noreferrer\">recent court case<\/a>, a federal judge ruled against a claim that Google had violated Illinois privacy laws by using uploaded pictures to create \u201cface templates\u201d without an individual\u2019s consent.\u00a0 The plaintiffs in the case either uploaded photos to an Android phone, or had photos uploaded of themselves.\u00a0 The photos were analyzed using Google\u2019s facial recognition software, which created a face template that allegedly was used to recognize individuals\u2019 personal characteristics, including age, gender, race and location.<\/p>\n<p>As reported by <a href=\"https:\/\/www.courthousenews.com\/judge-oks-google-facial-recognition-software\/\" target=\"_blank\" rel=\"noopener noreferrer\">Courthouse News<\/a>, the 2008\u00a0<em>Illinois Biometric Information Privacy Act<\/em> was one of the first laws to attempt to regulate biometric privacy.\u00a0 The law is also unique in that it allows private individuals to sue for damages when their rights under the law are violated, including as a class action.\u00a0 Civil remedies like this can provide a way for individuals to be compensated for harms and losses, as well as provide an additional financial incentive for companies to respect individual privacy rights.<\/p>\n<h3>Proving harm, or substantial risk<\/h3>\n<p>The challenge with civil remedies is that they generally require a demonstration of harm or injury \u2013 and not all types of harm or injury are recognized by courts, or easy to prove.\u00a0 Privacy violations fall into this category, and <a href=\"https:\/\/ia800807.us.archive.org\/13\/items\/gov.uscourts.ilnd.323329\/gov.uscourts.ilnd.323329.207.0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">the text of the decision<\/a> illustrates some of the reasons why.<\/p>\n<p>While Google collected, stored and applied facial recognition processes to individuals\u2019 photos without consent, part of the reason the legal case failed was because the plaintiffs couldn\u2019t demonstrate that they had actually been harmed.\u00a0 They argued that with their photographs and related personal information could be sold, used internally for profit or advertising, or inadvertently compromised in a data breach.<\/p>\n<p>However, the judge found that even though the information was gathered without consent, no actual harm had occurred.\u00a0 It wasn\u2019t enough that the plaintiffs feared that their information would be compromised, used to profit, or sold in the future \u2013 that harm had to actually happen, or be substantially likely to happen.\u00a0 Evidence of recent breaches at Google (Google+) and potential future uses of the technology was not enough to persuade the judge that the potential for harm was high enough for the claim to proceed.<\/p>\n<h3>Privacy laws need effective enforcement tools<\/h3>\n<p>Cases like this illustrate some key areas of difficulty in drafting privacy legislation.\u00a0 While harm doesn\u2019t always need to be proven for the state to impose a fine or other penalty, cases brought by individuals are generally held to a different standard.\u00a0 In a world where privacy breaches can have swift and dramatic consequences for personal health and safety, we need enforcement tools that can address risk proactively, rather than waiting until the damage is done.<\/p>\n<p>In the meantime, maybe it\u2019s time to <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/how-to-delete-your-google-photos\/\">delete those selfies<\/a> from Google Photos.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>As new privacy laws attempt to address the different ways that companies collect, store and use biometric data, it\u2019s also important to keep an eye on how the courts are interpreting and applying legislation.
