Internet connection records include the metadata that are tied to all internet connections \u2013 examples include the internet activity timestamps, internet history, IP addresses used, etc. Dubbed the \u201cSnooper\u2019s Charter,\u201d the Investigatory Powers Act is a great example of supposedly first world countries looking with envy on the civil liberties violating internet control in authoritarian countries <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/uk-national-cyber-security-centre-wants-build-great-firewall-britain\/\">like China<\/a>. While the Investigatory Powers Act has actually been <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/uk-court-delivers-blow-mass-surveillance-state-win-privacy-advocates\/\">ruled against by UK court<\/a>, the government is now seeking to expand access to their internet surveillance trove.<\/p>\n<h2>New entities to be allowed to access internet connection records originally intended only for anti-terrorism use<\/h2>\n<p>The British Government is seeking approval to add five more governmental entities to the long list of non police organizations that can access your internet activity with just a rubber stamp. These five new organizations are:<\/p>\n<ul>\n<li>The Civil Nuclear Constabulary<\/li>\n<li>The Environment Agency<\/li>\n<li>The Insolvency Service<\/li>\n<li>UK National Authority for Counter Eavesdropping (UKNACE)<\/li>\n<li>The Pensions Regulator<\/li>\n<\/ul>\n<p>It\u2019s worth recalling that there are already plenty of organizations that have been allowed to utilize the mass amounts of internet activity scooped up by the Investigatory Powers Act. According to the <a href=\"https:\/\/www.ibtimes.co.uk\/big-brother-watching-you-every-organisation-allowed-snoop-your-internet-history-revealed-1593830\" target=\"_blank\" rel=\"noopener noreferrer\">IB Times<\/a>, the existing organizations that have access to your internet connection records include:<\/p>\n<ul>\n<li>Metropolitan police force<\/li>\n<li>City of London police force<\/li>\n<li>Police forces maintained under section 2 of the Police Act 1996<\/li>\n<li>Police Service of Scotland<\/li>\n<li>Police Service of Northern Ireland<\/li>\n<li>British Transport Police<\/li>\n<li>Ministry of Defence Police<\/li>\n<li>Royal Navy Police<\/li>\n<li>Royal Military Police<\/li>\n<li>Royal Air Force Police<\/li>\n<li>Security Service<\/li>\n<li>Secret Intelligence Service<\/li>\n<li>GCHQ<\/li>\n<li>Ministry of Defence<\/li>\n<li>Department of Health<\/li>\n<li>Home Office<\/li>\n<li>Ministry of Justice<\/li>\n<li>National Crime Agency<\/li>\n<li>HM Revenue &amp; Customs<\/li>\n<li>Department for Transport<\/li>\n<li>Department for Work and Pensions<\/li>\n<li>NHS trusts and foundation trusts in England that provide ambulance services<\/li>\n<li>Common Services Agency for the Scottish Health Service<\/li>\n<li>Competition and Markets Authority<\/li>\n<li>Criminal Cases Review Commission<\/li>\n<li>Department for Communities in Northern Ireland<\/li>\n<li>Department for the Economy in Northern Ireland<\/li>\n<li>Department of Justice in Northern Ireland<\/li>\n<li>Financial Conduct Authority<\/li>\n<li>Fire and rescue authorities under the Fire and Rescue Services Act 2004<\/li>\n<li>Food Standards Agency<\/li>\n<li>Food Standards Scotland<\/li>\n<li>Gambling Commission<\/li>\n<li>Gangmasters and Labour Abuse Authority<\/li>\n<li>Health and Safety Executive<\/li>\n<li>Independent Police Complaints Commissioner<\/li>\n<li>Information Commissioner<\/li>\n<li>NHS Business Services Authority<\/li>\n<li>Northern Ireland Ambulance Service Health and Social Care Trust<\/li>\n<li>Northern Ireland Fire and Rescue Service Board<\/li>\n<li>Northern Ireland Health and Social Care Regional Business Services Organisation<\/li>\n<li>Office of Communications<\/li>\n<li>Office of the Police Ombudsman for Northern Ireland<\/li>\n<li>Police Investigations and Review Commissioner<\/li>\n<li>Scottish Ambulance Service Board<\/li>\n<li>Scottish Criminal Cases Review Commission<\/li>\n<li>Serious Fraud Office<\/li>\n<li>Welsh Ambulance Services National Health Service Trust<\/li>\n<\/ul>\n<h2>Why is the UK expanding the Investigatory Powers Act?<\/h2>\n<p>According to the <a href=\"https:\/\/www.legislation.gov.uk\/ukdsi\/2020\/9780111195499\/pdfs\/ukdsiod_9780111195499_en.pdf\">memorandum<\/a> sent out as justification for the expansion of the list of entities that have access to the surveillance data:<\/p>\n<blockquote><p>\u201cThese regulations include the addition of five public authorities who will gain the power to obtain communications data as they are increasingly unable to rely on local police forces to investigate crimes on their behalf.\u201d<\/p><\/blockquote>\n<p>Right off the bat, it\u2019s worth repeating that the police shouldn\u2019t have rubber stamp access to the internet connection records, but they have since 2016. Now that they do have that power, it\u2019s being pushed that other agencies need that power to be able to snoop on citizen internet use for investigatory purposes and the stated reason is because it\u2019s not enough that the police have warrantless access. It\u2019s a wet dream of any government agency to be able to snoop around and do their job without having any judicial oversight. The Insolvency Service specifically tried to justify their access to internet connection records by stating the obvious:<\/p>\n<blockquote><p>\u201cIP addresses and underlying e-mail account details will also be increasingly useful lines of enquiry to solve crimes within their remit.\u201d<\/p><\/blockquote>\n<p>Sure, any entity could theoretically do their job better if they\u2019re able to violate the privacy of all the citizens they\u2019re supposed to serve \u2013 this has been the case long before technology allowed for easy mass surveillance. However, civil liberties which are supposed to be protected by the government are supposed to stand in the way of exactly this type of gross misuse of government powers. The mass surveillance regime shouldn\u2019t even exist in the first place \u2013 but it does.<\/p>\n<p>Remember that the Investigatory Powers Act was originally touted as an anti-terrorism precaution. As privacy advocates have long warned, that is always the beginning. Now that the government has all this data on internet activity \u2013 it\u2019s inevitable that its use gets expanded into activities that don\u2019t even remotely involve countering terrorism or protecting national security.
