That key piece of legislation is the Communications Decency Act of 1996 \u2013 specifically Section 230. The <a href=\"https:\/\/www.hawley.senate.gov\/wp-content\/uploads\/files\/2020-06\/Limiting-Section-230-Immunity-to-Good-Samaritans-Act.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">proposed legislation<\/a> was brought forth by Senator Josh Hawley (R-MO), Senator Marco Rubio (R-FL), Senator Tom Cotton (R-AR), Senator Mike Braun (R-IN), and Senator Kelly Loeffler (R-GA). As the name of the bill suggests, the bill would limit the immunity granted by Section 230 only to \u201cGood Samaritans.\u201d The thing is, it\u2019d be up to the government to decide what qualifies as a \u201cGood Samaritan,\u201d and once that door is opened \u2013 it can\u2019t be shut.<\/p>\n<p>According to <a href=\"https:\/\/www.hawley.senate.gov\/senator-hawley-announces-bill-empowering-americans-sue-big-tech-companies-acting-bad-faith\/\" target=\"_blank\" rel=\"noopener noreferrer\">Senator Hawley\u2019s website<\/a>, qualifying means this:<\/p>\n<blockquote><p>\u201cThe Limiting Section 230 Immunity to Good Samaritans Act provides that Big Tech companies who want to receive section 230 immunity must bind themselves contractually to a duty of good faith.\u201d<\/p><\/blockquote>\n<p>What counts as good faith? Well there\u2019s a current answer for that, too:<\/p>\n<blockquote><p>\u201cThe duty of good faith would contractually prohibit Big Tech from:<\/p><\/blockquote>\n<ul>\n<li>\n<blockquote><p>Discriminating when enforcing the terms of service they write (just like police and prosecutors are not supposed to discriminate when enforcing the law);<\/p><\/blockquote>\n<\/li>\n<li>\n<blockquote><p>Failing to honor their promises;<\/p><\/blockquote>\n<\/li>\n<li>\n<blockquote><p>Big Tech companies who breach their duty of good faith would have to pay $5,000 or actual damages, whichever is higher, plus attorney\u2019s fees to each user who prevails.\u201d<\/p><\/blockquote>\n<\/li>\n<\/ul>\n<h2>What is Section 230<\/h2>\n<p>The Communications Decency Act\u2019s key provision, Section 230, is oft touted as the most important law protecting internet speech that exists. The section formally <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/47\/230\">reads<\/a>:<\/p>\n<p>\u201cNo provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider\u201d<\/p>\n<p>One key effect is that websites on the internet aren\u2019t legally liable for the things that users put onto their website. Video websites like YouTube and social media sites like Reddit and Facebook aren\u2019t liable for their users\u2019 posts; also, blogs and news sites like this one are not liable for the comments left by commenters. Without this cornerstone piece of internet legislation, the internet would be a much more restrictive \u2013 and less free \u2013 place. The <a href=\"https:\/\/www.wsj.com\/articles\/justice-department-to-propose-limiting-internet-firms-protections-11592391602\" target=\"_blank\" rel=\"noopener noreferrer\">Justice Department<\/a> is also going to introduce an attack \u2013 and the <a href=\"https:\/\/www.fastcompany.com\/90514845\/despite-shaky-legality-trumps-section-230-executive-order-is-still-dangerous\" target=\"_blank\" rel=\"noopener noreferrer\">executive order<\/a> from President Trump, which was hinted at <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/president-trump-wants-to-use-an-executive-order-to-make-the-fcc-and-ftc-police-social-media-censorship\/\">months ago<\/a>, makes up the third arm. Previous attempts to do away with Section 230 include <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/dear-president-trump-dont-sign-sesta-fosta-let-internet-haveavoice\/\">SESTA-FOSTA<\/a> and many more which have thus far been limited in success. Working to keep Section 230 of the Communications Decency Act is something that internet businesses both large and small have traditionally been able to rally around.
