Apparently, the FCC\u2019s version of net neutrality really does contain a gaping hole<\/a> for anything copyright-monopoly-related. The little qualifier \u201clawful\u201d in the sentence that \u201call lawful traffic must be treated equally\u201d turned out to mean that ISPs may now be required to police the net for copyright monopoly infringements, acting as police, prosecutor, judge, and executioner \u2013 often in complex cases, denying citizens any and all due process. This is starting to become a pattern.<\/strong><\/p>\n

It\u2019s become more and more apparent, that the word \u201clawful\u201d in any policy matters has become synonymous with \u201cevil\u201d. Any and every time something is described as \u201clawful\u201d, it could just as well have been described as \u201cdespicable\u201d, \u201cunjust\u201d, \u201ccorrupt\u201d, or \u201cviolating human rights\u201d.<\/p>\n

The reason is simple: if you presented something good and desirable, you would never point out that it were lawful in the first place, regardless of whether it were or not.<\/strong> \u201cLawful\u201d has become a justification<\/em> for anything and everything in society that is being shoved down the throat of the net generation against their will.<\/p>\n

You can observe the exact same thing with \u201cLawful interception\u201d groups in telecoms standards committees, where \u201cinterception\u201d means \u201cwiretapping\u201d \u2013 i.e. interception of communications. They design the standards for wiretapping. It\u2019s easy to argue that such wiretapping is only used to track criminals \u2013 but in many parts of the world, those criminals are simply people who have a different opinion than the current administration. And here in the West, pre-emptive surveillance \u2013 i.e. bulk warrantless wiretapping \u2013 have become the norm. \u201cLawful\u201d. That\u2019s the only word you see to justify it. Because there really is no other word that would<\/em> justify it. And that, in turn, highlights the words of Thomas Jefferson:<\/p>\n

\u201cIf a law is unjust, a man is not only right to disobey it, he is obligated to do so.\u201d \u2014 Thomas Jefferson<\/em><\/p><\/blockquote>\n

Whenever you see the word \u201clawful\u201d, alarm bells should go off. That\u2019s being used to justify something evil.<\/p>\n

(This doesn\u2019t mean that the FCC\u2019s net neutrality is all bad, or even mostly bad. The jury will remain out on that one for some time, and there\u2019s reason to remain overall hopeful: The U.S. has been lagging behind the world due to lack of net neutrality, and it needed to be enforced against a cartel-like oligopoly. This column merely observes how language \u2013 the word \u201clawful\u201d \u2013 is being used to obscure really bad things you\u2019d want to know about in advance.)<\/p>\n
