The bill (full text) was submitted by Representatives Sylvia Garcia (D-TX) and Ann Wagner (R-MO) and while it has not passed the Senate floor yet, the <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/act-now-to-protect-encryption-and-make-sure-that-there-is-no-earn-it-act-passed\/\">EARN IT Act has passed the Senate Judiciary Committee<\/a>. The proposed bill would use the threat of civil litigation to force services to break encryption lest they fail to \u201cearn\u201d legal protections under Section 230 of the Communications Decency Act (CDA).<\/p>\n<p>If the <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/the-earn-it-act-is-the-latest-clueless-attack-on-encryption-do-not-fall-for-it\/\">EARN IT Act<\/a> is passed, it would create a \u201cNational Commission on Online Child Exploitation Prevention\u201d (NCOCEP) that will be responsible for drafting a set of rules that internet companies must follow in order to continue being eligible for protections under Section 230 of the CDA \u2013\u00a0 which is under attack from all sides including the <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/savefreespeechonline-org-lets-you-comment-against-trumps-censor-the-internet-executive-order\/\">Censor the Internet executive order<\/a>.<\/p>\n<p>The NCOCEP would be headed by <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/us-attorney-general-demands-encryption-backdoors-at-all-costs-and-for-you-to-just-accept-it\/\">Attorney General Bill Barr<\/a> would head the NCOCEP \u2013 and he is well known proponent of encryption backdoors \u2013 which is the same thing as saying someone is a flat earther \u2013 a denier of the laws of mathematics. After all, there is no such thing as an encryption backdoor that only the government can access. Part of the EARN IT Act\u2019s core mission is to give the government the writ to force tech companies like Facebook, Apple, etc to build backdoors into their encryption.<\/p>\n<p>Riana Pfefferkorn, writing for <a href=\"https:\/\/cyberlaw.stanford.edu\/blog\/2020\/01\/earn-it-act-how-ban-end-end-encryption-without-actually-banning-it\/\" target=\"_blank\" rel=\"noopener noreferrer\">Stanford\u2019s Center for Internet and Society<\/a>, identified the bill\u2019s mission:<\/p>\n<blockquote><p>\u00a0\u201cto ban end-to-end encryption without actually banning it.\u201d<\/p><\/blockquote>\n<h2>Protect encryption: Call your House Representative today and tell them to vote \u201cNO\u201d on the EARN IT Act<\/h2>\n<p>Around the world, countries use the easily palatable-to-the-public war cries of \u201canti terrorism\u201d or \u201cprotect the children\u201d to launch thinly veiled attacks at encryption technologies and the Internet as a whole. It is time to act now to prevent the EARN IT Act from passing the House of Representatives.
