The court decisions came as a result of a case from journalistic outfit amaBhungane and journalist Sam Sole \u2013 who were subject to bulk surveillance and weren\u2019t notified of it during or post-surveillance. The <\/span><a href=\"https:\/\/cpj.org\/2021\/02\/cpj-welcomes-south-african-constitutional-courts-ruling-condemning-surveillance\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Committee to Protect Journalists<\/span><\/a><span style=\"font-weight: 400;\"> (CPJ) Africa program coordinator, Angela Quintal, commented:<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cJournalist Sam Sole\u2019s communications should never have been intercepted, but the South African Constitutional Court\u2019s ruling today, which confirms that laws permitting such actions are unconstitutional, is an important step toward creating a safe working environment for the press. The right to privacy is critical for press freedom to flourish, and court rulings against surveillance must be backed with the political will to prevent further abuses. Surveillance of journalists remains a grave concern across the region and around the world.\u201d<\/span><\/p><\/blockquote>\n<h2><span style=\"font-weight: 400;\">Highest Court in South Africa reaffirms previous decision against bulk surveillance<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Concourt found that many aspects of the Regulation of Interception of Communications and Provision of Communication-Related Information Act (RICA), such as lack of disclosure even post-surveillance are unconstitutional. The Concourt has given the South African government three years to draft new legislation to replace RICA \u2013 but in the meantime, RICA will remain active.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This court decision from the highest court in South Africa came about as a result of the Minister of State Security appealing a <\/span><a href=\"https:\/\/www.privateinternetaccess.com\/blog\/south-african-court-rules-that-mass-surveillance-by-the-government-is-illegal\/\"><span style=\"font-weight: 400;\">previous decision from 2019 by a lower court that had already declared bulk surveillance unlawful<\/span><\/a><span style=\"font-weight: 400;\">. Now that the highest court has backed up the decision, the South African government has no other legal recourse to fight this monumental ruling.\u00a0 The Minister of Police did note that the inability of South Africa\u2019s law enforcement to use bulk surveillance will undoubtedly increase the use of secret court orders known as interception directions similar to <\/span><a href=\"https:\/\/www.privateinternetaccess.com\/blog\/the-us-government-admits-to-using-the-patriot-act-to-collect-web-browsing-information\/\"><span style=\"font-weight: 400;\">FISA court warrants<\/span><\/a><span style=\"font-weight: 400;\"> in the United States.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>South Africa\u2019s Constitutional Court \u2013 or Concourt as it is often referred to \u2013 has banned mass surveillance of internet communications in the country.
