{"id":1662,"date":"2015-09-04T02:58:44","date_gmt":"2015-09-04T09:58:44","guid":{"rendered":"https:\/\/www.privateinternetaccess.com\/blog\/?p=1662"},"modified":"2020-08-26T15:16:27","modified_gmt":"2020-08-26T22:16:27","slug":"norways-censorship-of-the-pirate-bay-yet-another-uptick-for-vpns-and-alternate-dns","status":"publish","type":"post","link":"https:\/\/www.privateinternetaccess.com\/blog\/norways-censorship-of-the-pirate-bay-yet-another-uptick-for-vpns-and-alternate-dns\/","title":{"rendered":"Norway&#8217;s Censorship Of The Pirate Bay Yet Another Uptick For VPNs And Alternate DNS"},"content":{"rendered":"<p><strong>A Norwegian district court has seen it fit to <a href=\"https:\/\/torrentfreak.com\/pirate-sites-must-pay-legal-costs-of-own-blockade-court-rules-150902\/\">order censorship<\/a> of The Pirate Bay and other sites that are sometimes used to violate the entertainment distribution monopoly we know as \u201ccopyright\u201d. Ignoring the rules surrounding fundamental rights, ignoring that European courts have previously ruled such censorship ineffective to accomplish the dubious goal, the Norwegian court still went ahead as requested by the copyright industry. The net effect will be an upswing in VPN use and in traffic to The Pirate Bay, as we have seen elsewhere.<\/strong><\/p>\n<p>This ruling has numerous problems.<\/p>\n<p>First, let us establish that this is textbook censorship. It is the government preventing two consenting parties from communicating things they desire to communicate with each other. It is entirely beside the point that some of this communication has been found to violate distribution monopolies in the past; preventing such communication <em>a priori<\/em>, before it has even taken place, without letting it happen and then trying it legally, is textbook censorship and something that has no place in a modern society. (For reference, many indie artists and others depend on The Pirate Bay and torrent technology to distribute material, which is obviously legal \u2013 these are also hit by the blanket censorship, which should raise serious concern if not outrage.)<\/p>\n<p>Second, let us establish that it is trivially circumventable, and so, completely ineffective (as a Dutch court <a href=\"https:\/\/torrentfreak.com\/isps-no-longer-have-to-block-the-pirate-bay-dutch-court-rules-140128\/\">has already found<\/a>). As this is censorship at the name-server level, equivalent to inserting bad records into a phone book \u2013 essentially ordering the ISP\u2019s name lookup servers to lie in response to certain requests \u2013 it is circumventable as trivially as changing your DNS settings to use Google\u2019s name server (the easily-remembered 8.8.8.8) instead of your ISP\u2019s suggested name server. Some prefer using a VPN instead \u2013 many offer two convenient services here: the ability to egress in any country (meaning you seem to be a native of that country) and the more important anonymization. This may be the reason for a shrug rather than an outrage: the reaction is mainly \u201cohwell, time to change my DNS settings. I should have done that a long time ago anyway.\u201d<\/p>\n<p>Third, any censorship that is ineffective to this degree is illegal under ECHR rules (European Convention on Human Rights). Any restriction of human rights must be necessary (it must target an identified problem), effective (it must solve that problem), and proportionate (it must not create worse problems in the process). Attacking copyright monopoly violations by creating censorship fails the second and third points miserably.<\/p>\n<p>Fourth, let us establish that the copyright industry\u2019s longer game here is to establish censorship as normal and expected, even if everybody knows it\u2019s trivially circumventable. Once public opinion has shifted to expect it, they reason, they can slam down the hammer with censorship that actually works \u2013 the same strategy that was used when the copyright industry <a href=\"https:\/\/www.techdirt.com\/2010\/04\/28\/anti-piracy-group-says-child-porn-is-great-since-it-gets-politicians-to-block-file-sharing-sites\/\">lobbied politicians<\/a> for child porn \u201cfilters\u201d (censorship), despite such filters actually leading to <a href=\"https:\/\/www.techdirt.com\/2011\/07\/12\/how-copyright-lobbyists-are-making-child-porn-problem-worse\/\">more<\/a> abused children, with the industry having an ulterior motive of later applying the same \u201cfilter\u201d (censorship) to sites like The Pirate Bay. This was also exactly what happened in the UK and other places.<\/p>\n<p>At the end of the day, it must be realized that the copyright monopoly is a commercial distribution monopoly for an entertainment industry. It has no business whatsoever being \u201cbalanced\u201d against fundamental rights; if the copyright industry cannot sustain a business in the face of contemporary civil liberties (including the right to communicate anything to anybody anonymously), their option is to go out of business.
