Its main market is currently <a href=\"https:\/\/www.clearview.ai\/overview\" target=\"_blank\" rel=\"noopener\">law enforcement<\/a>, with which it has already had <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/privacy-organizations-call-for-facial-recognition-to-be-regulated-or-even-banned-as-police-turn-to-clearview-ai\/\">considerable success in the US<\/a>. But two years is a long time in digital technology, and Clearview AI is moving forward. In October last year, its co-founder and CEO, Hoan Ton-That, told Wired that his company had now collected more than <a href=\"https:\/\/www.wired.com\/story\/clearview-ai-new-tools-identify-you-photos\/\" target=\"_blank\" rel=\"noopener\">ten billion images<\/a>. It was also working on new technologies, including \u201cdeblur\u201d and \u201cmask removal\u201d tools. Around the same time, Clearview AI\u2019s system was tested independently by the The National Institute of Standards and Technology, and fared \u201c<a href=\"https:\/\/www.nytimes.com\/2021\/10\/28\/technology\/clearview-ai-test.html\" target=\"_blank\" rel=\"noopener\">surprisingly well<\/a>\u201c. In January of this year, the company was <a href=\"https:\/\/guce.yahoo.com\/consent?brandType=nonEu&amp;gcrumb=WmiE9TY&amp;done=https%3A%2F%2Ffinance.yahoo.com%2Fnews%2Fclearview-ai-revolutionary-facial-recognition-110000311.html\" target=\"_blank\" rel=\"noopener\">awarded a US patent<\/a> for its identification technology, specifically for its ability \u201cto gather publicly available information from the open internet (social media sites, mugshots, news sites and more) and then accurately match similar photos using its proprietary facial recognition algorithm.\u201d<\/p>\n<p>That approach of scraping facial images from public sites is highly controversial, and has led to considerable pushback across the spectrum. Early on, <a href=\"https:\/\/www.nytimes.com\/2020\/01\/22\/technology\/clearview-ai-twitter-letter.html\" target=\"_blank\" rel=\"noopener\">Twitter<\/a>, <a href=\"https:\/\/www.engadget.com\/2020-02-05-google-tells-clearview-at-stop-scraping-photos.html\" target=\"_blank\" rel=\"noopener\">Google<\/a>, <a href=\"https:\/\/arstechnica.com\/tech-policy\/2020\/02\/facebook-youtube-order-clearview-to-stop-scraping-them-for-faces-to-match\/\" target=\"_blank\" rel=\"noopener\">Facebook<\/a>, and <a href=\"https:\/\/x.com\/RMac18\/status\/1225511319803174916\" target=\"_blank\" rel=\"noopener\">LinkedIn<\/a> all told the company to stop harvesting photos from their services. In June 2020, the European Data Protection Board (<a href=\"https:\/\/www.edpb.europa.eu\/about-edpb\/about-edpb\/who-we-are_en\" target=\"_blank\" rel=\"noopener\">EDPB<\/a>), an independent European body that contributes to the consistent application of data protection rules throughout the European Union, <a href=\"https:\/\/www.edpb.europa.eu\/news\/news\/2020\/thirty-first-plenary-session-establishment-taskforce-tiktok-response-meps-use_en\" target=\"_blank\" rel=\"noopener\">wrote<\/a>:<\/p>\n<blockquote><p>Without prejudice to further analysis on the basis of additional elements provided, the EDPB is therefore of the opinion that the use of a service such as Clearview AI by law enforcement authorities in the European Union would, as it stands, likely not be consistent with the EU data protection regime.<\/p><\/blockquote>\n<p>That was an early indication that Clearview AI\u2019s approach would run afoul of the EU\u2019s privacy laws. As it turned out, other countries moved first: in February last year, Canada\u2019s Office of the Privacy Commissioner said the company <a href=\"https:\/\/techcrunch.com\/2021\/02\/03\/clearview-ai-ruled-illegal-by-canadian-privacy-authorities\/\" target=\"_blank\" rel=\"noopener\">violated the country\u2019s privacy laws<\/a>. In November, Clearview AI was ordered to <a href=\"https:\/\/www.theverge.com\/2021\/11\/3\/22761001\/clearview-ai-facial-recognition-australia-breach-data-delete\" target=\"_blank\" rel=\"noopener\">delete all facial recognition data<\/a> referring to Australian citizens. Shortly afterwards, the UK\u2019s Information Commissioner\u2019s Office announced its \u201cprovisional intent to impose a potential fine of just over \u00a317 million on Clearview AI\u201d. The first <a href=\"https:\/\/www.theverge.com\/2021\/12\/16\/22840179\/france-cnil-clearview-ai-facial-recognition-privacy-gdpr\" target=\"_blank\" rel=\"noopener\">GDPR ruling against Clearview AI<\/a> came in December last year, from France. Other legal complaints against the company are still being dealt with in <a href=\"https:\/\/noyb.eu\/en\/digital-rights-alliance-file-legal-complaints-against-facial-recognition-company-clearview-ai\" target=\"_blank\" rel=\"noopener\">Austria, Italy and Greece<\/a>. Meanwhile, in the US, Clearview AI is accused of violating the <a href=\"https:\/\/www.biometricupdate.com\/202202\/clearview-ai-ponders-broader-facial-recognition-service-free-speech-defense-rejected\" target=\"_blank\" rel=\"noopener\">biometric data privacy law in Illinois<\/a>, and faces class action lawsuits in <a href=\"https:\/\/www.wired.com\/story\/clearview-ai-new-tools-identify-you-photos\/\" target=\"_blank\" rel=\"noopener\">New York and California<\/a>. US politicians have also called for the <a href=\"https:\/\/pressley.house.gov\/sites\/pressley.house.gov\/files\/Letters%20to%20Federal%20Agencies%20on%20Clearview%20AI.pdf\" target=\"_blank\" rel=\"noopener\">Department of Homeland Security<\/a> to stop using Clearview AI\u2019s product. One of the most dramatic recent developments in the Clearview AI story is <a href=\"https:\/\/www.washingtonpost.com\/technology\/2022\/02\/16\/clearview-expansion-facial-recognition\/\" target=\"_blank\" rel=\"noopener\">a report in the Washington Post<\/a>, which appeared last week:<\/p>\n<blockquote><p>The facial recognition company Clearview AI is telling investors it is on track to have 100 billion facial photos in its database within a year, enough to ensure \u201calmost everyone in the world will be identifiable,\u201d according to a financial presentation from December obtained by The Washington Post.<\/p>\n<p>\u2026<\/p>\n<p>And the company wants to expand beyond scanning faces for the police, saying in the presentation that it could monitor \u201cgig economy\u201d workers and is researching a number of new technologies that could identify someone based on how they walk, detect their location from a photo or scan their fingerprints from afar.<\/p><\/blockquote>\n<p>The story is based on a 55-page \u201cpitch deck\u201d. In it, Clearview AI claims that with $50 million from investors \u2014 a surprisingly small sum compared to the valuations of other digital companies \u2014 it could grow its database to encompass almost everyone on the planet, or at least everyone for whom there is a digital photo. In addition, it would aim to expand its international sales team and spend more on lobbying government policymakers to \u201cdevelop favorable regulation\u201d. Although that is unlikely to apply in the EU, where the GDPR is the cornerstone of the region\u2019s privacy laws, many other parts of the world lack similar legislation. Clearview AI doubtless sees opportunities to persuade lawmakers there to pass data protection laws that are compatible with its service. Significantly, the deck shows that Clearview AI has ambitions beyond law enforcement:<\/p>\n<blockquote><p>the presentation shows the company has based its \u201cproduct expansion plan\u201d on boosting corporate sales, from financial services and the gig economy to commercial real estate. On a slide devoted to its \u201ctotal addressable market,\u201d government and defense contracts are shown as a small fraction of potential revenue, with other possible sources including in banking, retail and e-commerce.<\/p><\/blockquote>\n<p>It\u2019s important to note that this is just a pitch to investors, and Clearview AI\u2019s plans to build a monster facial database may never be realized. But the prospect alone is deeply troubling: if ever constructed, it would spell the end of public anonymity. More or less anyone, anywhere, could be identified when out in the open, with all the implications that has for basic human rights. In effect, privacy would no longer exist in public spaces. It would also be seriously compromised in private ones, since increasing numbers of \u201csmart\u201d devices come with cameras that could be used to monitor who is doing what in offices, in shops, and in the home.<\/p>\n<p>Even if Clearview AI fails to obtain the investment it seeks, it is quite likely that others \u2014 notably intelligence services of major powers \u2014 are already building such a total database, just rather more discreetly than Clearview AI. Once digital images exist of most people on the planet, the temptation to harvest as many of them as possible, and to use them for total surveillance, will be extremely strong.
