{"id":20717,"date":"2022-05-25T18:36:19","date_gmt":"2022-05-26T01:36:19","guid":{"rendered":"https:\/\/www.privateinternetaccess.com\/blog\/?p=20717"},"modified":"2024-01-26T08:20:54","modified_gmt":"2024-01-26T16:20:54","slug":"the-eus-new-digital-services-act-what-does-it-mean-for-global-privacy","status":"publish","type":"post","link":"https:\/\/www.privateinternetaccess.com\/blog\/the-eus-new-digital-services-act-what-does-it-mean-for-global-privacy\/","title":{"rendered":"The EU&#8217;s New Digital Services Act \u2014 What Does it Mean for Global Privacy?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Three main bodies of the EU \u2014 the European Commission, European Council, and European Parliament \u2014 have reached a \u201c<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/IP_22_2545\" rel=\"nofollow\">political agreement<\/a>\u201d on the<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:52020PC0825&amp;from=en\" rel=\"nofollow\"> Digital Services Act<\/a> (DSA).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new law mainly deals with regulating illegal and harmful content online, which will have wide-reaching effects for online users around the world. While the main points of the act have been agreed, it\u2019s not yet finalized.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As it stands, the act will have a significant impact on global privacy, whether the finer details have been agreed on or not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A Movement Towards Greater Online Privacy<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When the legislation was first announced in 2020, it appeared the act would <strong>give internet users greater control over their online privacy<\/strong>. In particular, one of the greatest threats to online privacy \u2014 micro-targeted advertising \u2014 would be<a href=\"https:\/\/www.privateinternetaccess.com\/blog\/eu-politicians-want-europes-next-big-digital-law-to-tackle-micro-targeted-advertising-by-regulating-or-even-banning-it\/\"> regulated or even banned<\/a> under the new law.\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh3.googleusercontent.com\/ReVZUTur5GZ7kZg0IQeFxsYWWb6r1QSSXt1j4konR_w254UHoH1wJ-wKcQwapRIDzUKxcuaxfJpzgw14wHQuH7aySBUSsZLG_ixJlnq4CC1iV_aiHHPv-nXaDvliH3qCxSqNmC-sxqeE4_NkcA\" alt=\"\"><figcaption>Could the DSA put an end to targeted advertising?<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">As is often the case, however, the initial high hopes have not been fully realized. The final text<a href=\"https:\/\/ec.europa.eu\/info\/strategy\/priorities-2019-2024\/europe-fit-digital-age\/digital-services-act-ensuring-safe-and-accountable-online-environment_en#new-rules-in-a-nutshell\" rel=\"nofollow\"> bans certain types of ads on online platforms<\/a>, but only when they target children or rely on\u00a0 certain categories of personal data to target users, including ethnicity, political views, and sexual orientation.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Center for Democracy &amp; Technology highlighted that other <strong>privacy-friendly movements were dropped <\/strong>during negotiations. This includes the protection of end-to-end encrypted services and the right to use services anonymously.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the plus side, <strong>the act does include a new requirement for transparency<\/strong>, notably for micro-targeted ads. Under the legislation, websites should make information about their advertisements publicly available to help with the identification of unnecessary, illegal, or manipulative advertising.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that authorized individuals can audit advertisements to ensure they don\u2019t have a negative impact on the public, for example, on their health, security, or equality.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, online platforms should ensure that they publish information about advertisers, the delivery of advertisements, and the content they contain.\u00a0<\/p>\n\n\n\n<a style=\"text-decoration: none;\" href=\"https:\/\/www.privateinternetaccess.com\/buy-vpn-online?conversionpoint=eu_new_dsa\"><button class=\"bg-btn-1\">Protect Your Privacy <\/button><\/a>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>An End to General Online Monitoring<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another welcome feature of the DSA is that <strong>general monitoring by online services is forbidden<\/strong>, in order to further protect personal data and online privacy.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, the aim is to reduce general monitoring that could limit users\u2019 freedom of expression and access to information.\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh5.googleusercontent.com\/tMHqyyUOqhJoL9MrmQ20zo01WEqsTzjfR6jALrDYqPmiXIg_pvVrDPB_arYmmLAxAp_XwWRvWLTBcEP4QfIV4V79D48qG4PSAvrVRex6UyMc5HePhmwBqTuf_HBQpDX81XimoC8EimSxEuuc6A\" alt=\"\"><figcaption>General online monitoring could soon be a forbidden act.<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The DSA is also part of various EU legislations designed to bring global digital giants under control. One such legislation is the e<a href=\"https:\/\/www.privateinternetaccess.com\/blog\/here-comes-the-digital-markets-act-important-new-legislation-from-the-eu-boosting-privacy-and-interoperability\/\"> Digital Markets Act<\/a> (DMA), which <strong>prevents marketing giants such as Google and Apple from using non-public data<\/strong>, in an effort to tackle companies that abuse their marketing power.\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another new EU law with major implications for privacy and surveillance is the<a href=\"https:\/\/www.privateinternetaccess.com\/blog\/eu-unveils-proposals-for-wide-ranging-ai-regulation-with-a-global-reach-and-facial-recognition-systems-flagged-up-as-high-risk\/\"> Artificial Intelligence (AI) Act<\/a>, which <strong>regulates the use of AI systems <\/strong>that pose a threat to public safety and rights. For example, systems that manipulate human behavior with complete disregard of free will.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DMA and the AI Act are still grinding their way through the EU legislative process. But, as the (comparatively) rapid passage of the DSA shows, the EU can push through new laws relatively quickly if it wants to \u2014 especially if it has a strong incentive to do so.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Regaining Control \u2014 Is It Too Good to Be True?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the major motivations for the DSA is the considerable political and public pressure to <strong>limit the power of giant US corporations like Google and Facebook<\/strong>.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In part, that may just be crude anti-Americanism, but many believe\u00a0 these companies are simply too big and exert too much unbridled power over people\u2019s everyday lives.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The other reason flows from the fact that people and governments around the world feel broadly the same, but have yet to frame laws to address the problem. The EU is keen to be the first to bring in major legislation to create a benchmark that others might choose to work to, not least because it would be the easy option for legislators struggling to find good approaches.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, the EU is greatly encouraged by the way the <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/?s=gdpr\">General Data Protection Regulation (GDPR)<\/a> has become the global standard for privacy protection \u2014 despite the undoubted flaws with this law, and the fact that it still isn\u2019t being properly enforced throughout the EU.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nonetheless, the GDPR possesses one huge advantage over other approaches to handling privacy in the digital age \u2014 it exists and it\u2019s up and running. It provides a handy template for others to use as the basis for their own privacy laws. Bringing in the DSA, DMA and AI laws<a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/04\/25\/us-wont-catch-up-europe-tech-regulation-anytime-soon\/\" rel=\"nofollow\"> before the US and other countries catch up<\/a> means the EU has once more a chance to set the rules globally.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Elon Musk Effect<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We may be about to witness an early test-case of what happens when a US internet company and its culture come face to face with\u00a0 new EU laws.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.prnewswire.com\/news-releases\/elon-musk-to-acquire-twitter-301532245.html\" rel=\"nofollow\">It\u2019s no secret that Elon Musk wants to acquire Twitter<\/a>. If the deal goes through, it\u2019s expected he\u2019ll use the platform to <strong>demonstrate his commitment to free speech<\/strong>, which he describes as the \u201c<a href=\"https:\/\/www.politico.eu\/article\/elon-musk-europe-online-content-free-speech\/\" rel=\"nofollow\">bedrock of a functioning democracy<\/a>\u201c.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In response, Thierry Breton \u2014 the EU\u2019s commissioner for the internal market \u2014 told the Financial Times (<a href=\"https:\/\/www.ft.com\/content\/22f66209-f5b2-4476-8cdb-de4befffebe5\" rel=\"nofollow\">paywall<\/a>) that Musk\u2019s new Twitter style will be subject to the DSA\u2019s rules on moderating illegal and harmful content online. In his statement, he mentioned how Elon will be expected to comply with the rules, highlighting that \u201cit\u2019s not your rules which will apply here\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A few days later, Breton published <a href=\"https:\/\/twitter.com\/ThierryBreton\/status\/1523773895974612992\" rel=\"nofollow\">a bizarre video of himself and Musk<\/a> on his Twitter \u2014 supposedly sharing \u201ca quick message\u201d on platform regulation, but not really saying much at all on the matter.<a href=\"https:\/\/twitter.com\/elonmusk\/status\/1523798885205876736\" rel=\"nofollow\"> Musk replied on Twitter<\/a>, saying: \u201cGreat meeting! We are very much on the same page.\u201d\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Given what we know about the position of the EU and Musk, it seems unlikely that they\u2019re singing from the same hymn sheet. If the Twitter deal goes through, it should be interesting to find out over the coming months and years whether Musk will comply with the legislation that governs social media platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the real question is, will the DSA help us regain control over our personal data and digital privacy? Who knows. While it seemed promising at first, decision-makers appear to have dropped significant laws that would protect digital privacy. Still, we have hope.<\/p>\n\n\n\n<a style=\"text-decoration: none;\" href=\"https:\/\/www.privateinternetaccess.com\/buy-vpn-online?conversionpoint=eu_new_dsa\"><button class=\"bg-btn-1\">Try Private
