{"id":23653,"date":"2023-03-23T03:40:14","date_gmt":"2023-03-23T10:40:14","guid":{"rendered":"https:\/\/www.privateinternetaccess.com\/blog\/?p=23653"},"modified":"2023-04-17T04:37:33","modified_gmt":"2023-04-17T11:37:33","slug":"tracking-pixel-violates-gdpr","status":"publish","type":"post","link":"https:\/\/www.privateinternetaccess.com\/blog\/tracking-pixel-violates-gdpr\/","title":{"rendered":"Meta&#8217;s Tracking Pixel Violates GDPR and the EU Ban on Transatlantic Data Transfers"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">One of the most insidious forms of surveillance carried out routinely by web sites and their advertisers involves <a href=\"https:\/\/tannergrey.com\/pixel-tracking\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">tracking pixels<\/a>. These are graphic elements that are just one pixel in size, colored so as to be invisible on whatever page they appear. Visitors to a site can\u2019t see them, but as soon as the page is loaded, so is the tracking pixel, which causes a wide range of your personal data to be sent to the site.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The main tracking pixels are managed by <a href=\"https:\/\/developers.facebook.com\/docs\/meta-pixel\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Meta<\/a> and <a href=\"https:\/\/hawkemedia.com\/insights\/how-to-place-a-google-analytics-pixel\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Google<\/a>. Recently, it has emerged that the increasingly popular <a href=\"https:\/\/www.consumerreports.org\/electronics-computers\/privacy\/tiktok-tracks-you-across-the-web-even-if-you-dont-use-app-a4383537813\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">TikTok also makes use of tracking pixels<\/a>, gathering personal data about people whether or not they have TikTok accounts. TikTok tracking pixels have even been found on <a href=\"https:\/\/www.wsj.com\/articles\/tiktok-trackers-embedded-in-u-s-state-government-websites-review-finds-a2589f0\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">US state government sites.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, the tide may finally be turning against tracking pixels, in the EU at least. Once again, it is the Austrian privacy expert Max Schrems and his noyb.eu organization that is driving the change.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Are Tracking Pixels So Bad?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The problem with tracking pixels is that they gather information surreptitiously, without most users being aware. They are also opaque: even if a visitor to a site assumes that there are tracking pixels, it is rarely clear what personal data is being gathered. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tracking pixels represent a huge threat to online privacy because the three main companies offering them \u2013 Meta, Google, and TikTok \u2013 operate on such a scale that it is likely they have created extremely detailed databases of most people\u2019s online activities and interests. This information can then be used to sell <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/how-blacklight-illuminates-the-murky-world-of-ad-tracking-key-logging-canvas-fingerprinting-facebook-pixels-and-more\/\">micro-targeted advertising<\/a> all over the web.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last year, the Austrian Data Protection Authority ruled that the <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/bombshell-decision-that-use-of-google-analytics-in-austria-violates-top-eu-courts-ruling-boosts-gdpr-impact-again\/\">continuous use of Google Analytics violates the EU\u2019s GDPR<\/a>. The ruling against Google was the result of <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/max-schrems-files-101-complaints-across-30-european-countries-to-turbocharge-gdprs-impact-and-hes-not-the-only-one\/\">noyb.eu filing 101 complaints<\/a> against companies for alleged violation of the <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/eu-illegal-cookie-walls\/\">GDPR<\/a>. In the Austrian decision, the role of the tracking pixel was not highlighted so much as the transfer of personal data of EU citizens to the US.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, in a new decision from the Austrian Data Protection Authority, also as a result of a noyb.eu complaint, Meta\u2019s tracking pixel has been explicitly judged as violating both the GDPR and the top EU court\u2019s ban on transatlantic data transfers. As the noyb.eu post on the latest ruling emphasizes, the <a href=\"https:\/\/noyb.eu\/en\/austrian-dsb-meta-tracking-tools-illegal\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">ban on Meta\u2019s tracking tools<\/a> applies across the EU, and to many web sites currently live:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Decision relevant for almost all EU websites. Many websites use Facebook tracking technology to track users and show personalized advertisement. When websites include this technology they also forward all user data to the US multinational and onwards to the NSA. While the European Commission is still aiming to publish the <a href=\"https:\/\/noyb.eu\/en\/statement-eu-comission-adequacy-decision-us\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">third EU-US data transfer deal<\/a>, the fact that US law still allows bulk surveillance means that this matter will not be solved any time soon.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">EU Citizens Subject to US Mass Surveillance<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The US and the European Commission are still trying to come up with a framework that will allow EU personal data to be legally transferred to the US. Two previous versions \u2013 <a href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2015-10\/cp150117en.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Safe Harbor<\/a> and <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/top-eu-court-sinks-main-framework-for-sending-personal-data-across-the-atlantic\/\">Privacy Shield<\/a> \u2013 have been thrown out by the EU\u2019s highest court. Schrems is sceptical that <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/biden-eu-us-data-privacy-framework\/\" rel=\"nofollow\">the latest attempt<\/a> will fare any better than previous ones, which were struck down following legal action instigated by. Back in December, <a href=\"https:\/\/noyb.eu\/en\/statement-eu-comission-adequacy-decision-us\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">he wrote<\/a>: \u201cI can\u2019t see how this [new framework] would survive a challenge before the [EU] Court of Justice.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although the latest decisions only apply to the EU, and depend upon the GDPR, the authorities in the US are also concerned about the risks of large-scale and invisible surveillance carried out by tracking pixels. The US Federal Trade Commission recently took enforcement action against GoodRx and BetterHelp, two digital healthcare platforms, for allegedly sharing user health data with third parties for advertising, <a href=\"https:\/\/www.ftc.gov\/policy\/advocacy-research\/tech-at-ftc\/2023\/03\/lurking-beneath-surface-hidden-impacts-pixel-tracking\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">gathered using tracking pixels<\/a>. In a post, the FTC wrote:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Companies using tracking pixels that impermissibly disclose an individual\u2019s personal information (which may include health information) to third parties may be violating the FTC Act, the FTC\u2019s Health Breach Notification Rule, the HIPAA Privacy, Security, and Breach Notification Rules, other state or federal statutes involving the disclosure of personal information, and [their] privacy promises to consumers.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Gathering health-related data using pixel tracking is viewed as particularly harmful to people\u2019s privacy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pixel Data Collection Used for Political Gain<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another extremely sensitive topic involves collecting information on visitors\u2019 political views, which can also be monitored using pixels. This is a new area where noyb.eu is active, and it has just filed a series of complaints as a result of research with ZDF Magazin Royal. Analysis revealed German political parties were using micro-targeted ads on Facebook. Here\u2019s <a href=\"https:\/\/noyb.eu\/en\/political-microtargeting-facebook-election-promise-just-you\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">why that is problematic<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">One of the greatest dangers of political microtargeting is that a voters political opinion can be influenced and altered. Political parties can make countless promises to a specific groups of voters and can hide their personalized stance from the general public. This can lead to very different expectations in voters, which politics can never live up to. The result is a polarized society, and individual parties can create advantages for themselves in the election campaign by making contradictory promises.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The new research revealed that precisely this was happening. For example, the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Free_Democratic_Party_(Germany)\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">German FDP party<\/a> showed an ad to people with \u201cgreen\u201d interests stating that the party was in favor of \u201cmore climate protection\u201d. But simultaneously, the FDP showed an ad targeting \u201cfrequent travelers\u201d in which it promised \u201cno government measures, restrictions on freedom or bans\u201d. Because the ads were only shown to particular groups, the contradictory promises were never evident. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Political opinions are strongly protected under the GDPR, and noyb.eu claims practices by no less than six political parties are \u201cunlawful and a threat to democracy and to the privacy of voters\u201d.
