This is in stark constrast to the everyday area person\u2019s perception of justice, where the distribution monopoly laws command considerably less respect than even speed limits<sup>[1]<\/sup>. According to the ISP, the Police are provably spending expensive resources on pointless petty trifles.<\/strong><\/p>\n<p>For the first time, an ISP <a href=\"https:\/\/bahnhof.se\/press\/press-releases\/2016\/05\/19\/fildelning-i-topp-nar-polisen-utreder-brott-pa-internet\">publishes<\/a> statistics of what crimes the Police are investigating when requesting the release of internet subscriber identities. The so-called <a href=\"https:\/\/en.wikipedia.org\/wiki\/Telecommunications_data_retention\">Data Retention<\/a>, which is a governmental requirement to store data about everybody\u2019s communications in order to use it against them in the future, was originally justified as necessary for fighting organized crime and terrorism \u2013 but is now being used against ordinary sharing of music and movies, according to the ISP.<\/p>\n<p>\u201cWe want to publish these statistics in order to show the Police are violating people\u2019s privacy and spending resources on pointless trifles\u201d, says Jon Karlung, CEO of Bahnhof.<\/p>\n<p><a href=\"https:\/\/www.privateinternetaccess.com\/blog\/wp-content\/uploads\/2016\/05\/Bahnhof-large-1024x581.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2444\" src=\"https:\/\/www.privateinternetaccess.com\/blog\/wp-content\/uploads\/2016\/05\/Bahnhof-small.png\" alt=\"Frequency of police requests for subscriber data, by reason. File sharing stands out as the most frequent.\" width=\"572\" height=\"428\" srcset=\"https:\/\/www.privateinternetaccess.com\/blog\/wp-content\/uploads\/2016\/05\/Bahnhof-small.png 572w, https:\/\/www.privateinternetaccess.com\/blog\/wp-content\/uploads\/2016\/05\/Bahnhof-small-300x224.png 300w, https:\/\/www.privateinternetaccess.com\/blog\/wp-content\/uploads\/2016\/05\/Bahnhof-small-401x300.png 401w\" sizes=\"auto, (max-width: 572px) 85vw, 572px\" \/><\/a><\/p>\n<p>\u201cWe can also tell that these requests originate from many different places within the police force\u201d, Karlung continues. \u201cWe\u2019ve noted fifty different personal mail accounts sending requests, and five different group addresses, and even six requests over fax.\u201d<\/p>\n<p>Bahnhof notes that file sharing is by far the most requested type of \u201ccrime\u201d leading the Police to request a release of subscriber identities.<\/p>\n<p>However, the Bahnhof ISP has been die hard about privacy, and pointed at European privacy regulations, never releasing such data for crimes considered \u201cnon-serious\u201d, typically meaning crimes carrying fines or less than six months in prison. Therefore, Bahnhof has just refused to release identities of allegedly-file-sharing subscribers, against the instructions of both Police and the Swedish Telecoms Authority. This behavior of Bahnhof\u2019s is currently making its way through the courts, expected to end at the European Court of Justice, which is the court that established the privacy safeguards in the first place.<\/p>\n<p>It\u2019s particularly noteworthy that the Police has by far the most requests for ordinary file sharing to this ISP, <em>despite this ISP never releasing such data for ordinary file sharing<\/em> \u2013 you would assume the Police capable of learning. One would then speculate about the frequency with less-conscious ISPs, assuming it to be higher. Sadly, the vast majority of ISPs are not ready to take their country\u2019s police to the European Court of Justice over privacy fundamentals.<\/p>\n<p>So the Police are prioritizing investigations against commercial distribution monopoly violations over pretty much all other crime, and are sending requests <em>per fax.<\/em> You cannot get a more descriptive picture of the legal digital divide.<\/p>\n<p><sup>[1]<\/sup>Studies by prof.
