{"id":25030,"date":"2023-08-20T14:23:42","date_gmt":"2023-08-20T21:23:42","guid":{"rendered":"https:\/\/www.privateinternetaccess.com\/blog\/?p=25030"},"modified":"2024-01-23T22:22:22","modified_gmt":"2024-01-24T06:22:22","slug":"zoom-ai-blunder-threats-to-privacy","status":"publish","type":"post","link":"https:\/\/www.privateinternetaccess.com\/blog\/zoom-ai-blunder-threats-to-privacy\/","title":{"rendered":"What Zoom\u2019s AI Blunder Can Teach Us About Future Threats to Privacy"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">It\u2019s no surprise that AI is starting to seep into every kind of digital service, even if the frenzy over generative AI seems to be dying down somewhat.\u00a0But over on Stackdiary, Alex Ivanovs spotted something rather remarkable in Zoom\u2019s updated terms and conditions that involved AI.\u00a0The new wording seemed to give Zoom the right to treat content generated by its users as <a href=\"https:\/\/stackdiary.com\/zoom-terms-now-allow-training-ai-on-user-content-with-no-opt-out\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">training for AI programs<\/a>, and with no way to opt out.\u00a0The <a href=\"https:\/\/web.archive.org\/web\/20230726121923\/https:\/\/explore.zoom.us\/en\/terms\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">new terms<\/a> required users to grant Zoom \u201ca perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable\u201d license for a number of purposes, including:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">product and service development, marketing, analytics, quality assurance, machine learning, artificial intelligence, training, testing, improvement of the Services, Software, or Zoom\u2019s other products, services, and software, or any combination thereof;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">As a previous PIA blog post explained back in February, training AI on this kind of material carries <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/chatgpt-privacy\/\">major privacy risks<\/a>.\u00a0These issues are now more widely understood, and when people found out about Zoom\u2019s plans, many were outraged.\u00a0As Ivanovs explains in an update to his initial post \u2014 Zoom, now confronted by this reaction, engaged in some hasty damage limitation.\u00a0First, it published <a href=\"https:\/\/web.archive.org\/web\/20230807185224\/https:\/\/blog.zoom.us\/zooms-term-service-ai\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a blog post<\/a> explaining why it had made changes to the terms and conditions.\u00a0In addition, it inserted the following line into the <a href=\"https:\/\/web.archive.org\/web\/20230808112128\/https:\/\/explore.zoom.us\/en\/terms\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">section mentioning AI training<\/a>: \u201cNotwithstanding the above, Zoom will not use audio, video, or chat Customer Content to train our artificial intelligence models without your consent.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, as many were quick to point out, this changed very little since people were essentially offered the choice of accepting the possible use of their sessions for AI training or not accessing Zoom.\u00a0That\u2019s not just problematic, but <a href=\"https:\/\/techcrunch.com\/2023\/08\/08\/zoom-data-mining-for-ai-terms-gdpr-eprivacy\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">probably illegal in the EU<\/a>, where the courts have said such \u201c<a href=\"https:\/\/www.privateinternetaccess.com\/blog\/?s=forced+consent\">forced consent<\/a>\u201d is not permissible under the GDPR. The CEO of Zoom, Eric Yuan, wrote <a href=\"https:\/\/www.linkedin.com\/posts\/ericsyuan_given-that-many-friends-have-reached-out-activity-7094824287336861697-CGMy\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a LinkedIn post<\/a>, in which he blamed a \u201cprocess failure internally\u201d for the previous inclusion of AI training. More significantly, he wrote:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">We are commiting to all of our customers that we will not use any of their audio, video, chat, screen sharing, attachments and other communications like poll results, whiteboard, and reactions to train our AI models or third-party AI models.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That commitment was indeed incorporated in <a href=\"https:\/\/explore.zoom.us\/en\/terms\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a newer version of Zoom\u2019s terms and conditions<\/a>.\u00a0Those terms were drastically simplified compared to previous texts, with most of the troubling references to AI training removed.\u00a0However, a new term has been added, which reads as follows:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Telemetry data, product usage data, diagnostic data, and similar data that Zoom collects or generates in connection with your or your End Users\u2019 use of the Services or Software are referred to as Service Generated Data. Zoom owns all rights, title, and interest in and to Service Generated Data.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Zoom\u2019s \u201ctelemetry data\u201d is what most people call metadata: that is, ancillary data describing the main data, in this case, generated by customers during Zoom calls.\u00a0Zoom not only asserts its unequivocal ownership of this metadata, but it makes a clear distinction between metadata and customer-generated data.\u00a0As a result, its commitment not to use customer data to train AI systems does not apply to this data.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As PIA blog readers know, metadata can be just as revealing about people and their activities as the main data.\u00a0If Zoom uses this metadata to train its AI systems, it could easily also use techniques like data aggregation to extract highly personal and confidential information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another potential issue is that the company\u2019s latest terms and conditions state \u201cZoom does not use any of your audio, video, chat, screen sharing, attachments or other communications-like Customer Content (such as poll results, whiteboard, and reactions) to train Zoom or third-party artificial intelligence models.\u201d That commitment seems to refer to present activities (\u201cdoes not\u201d), not future ones (\u201cwill not\u201d).\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moreover, Section 15 of the terms and conditions requires users to \u201cagree that Zoom may modify, delete, and make additions to its guides, statements, policies, and notices, with or without notice to you.\u201d That means Zoom could change the terms to allow the use of customer-generated material for AI training at some point in the future.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One problem is that Zoom doesn\u2019t have the best track record on transparency.\u00a0The company has been implicated in <a href=\"https:\/\/web.archive.org\/web\/20230809130745\/https:\/\/www.cnet.com\/news\/privacy\/zoom-security-issues-zoom-buys-security-company-aims-for-end-to-end-encryption\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">numerous security and privacy issues<\/a> over the years.\u00a0More recently, <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2020\/11\/ftc-requires-zoom-enhance-its-security-practices-part-settlement\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Zoom settled with the US Federal Trade Commission<\/a> over allegations that the company \u201cmisled users by touting that it offered \u2018end-to-end, 256-bit encryption to secure users\u2019 communications,\u2019 when in fact it provided a lower level of security.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another, more general, problem is that if Zoom refrains from using customer data to train its AI systems now and in the future, it seems highly likely that other companies will not.\u00a0It will probably be difficult in the EU, but elsewhere the potential rewards from mining customer data in this way may outweigh the legal and financial risks of doing so.\u00a0If nothing else, Zoom\u2019s recent AI missteps have provided a timely warning of a new
