{"id":25254,"date":"2023-09-26T07:08:47","date_gmt":"2023-09-26T14:08:47","guid":{"rendered":"https:\/\/www.privateinternetaccess.com\/blog\/?p=25254"},"modified":"2024-01-24T03:54:33","modified_gmt":"2024-01-24T11:54:33","slug":"tiktok-hit-with-huge-gdpr-fine","status":"publish","type":"post","link":"https:\/\/www.privateinternetaccess.com\/blog\/tiktok-hit-with-huge-gdpr-fine\/","title":{"rendered":"TikTok Hit with \u20ac345 Million GDPR Fine as Privacy Protection Becomes a Key Issue"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">TikTok has officially come of age: it has joined an exclusive club of companies that have been hit with major fines for infringing on the EU\u2019s main privacy law, the <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/?s=gdpr\">GDPR<\/a>. The Irish Data Protection Commission (DPC) has imposed <a href=\"https:\/\/www.dataprotection.ie\/en\/news-media\/press-releases\/DPC-announces-345-million-euro-fine-of-TikTok\" rel=\"nofollow\">a \u20ac345 million fine<\/a> (about $370 million) on the company for failing to protect children\u2019s personal data in multiple ways.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DPC began its investigations two years ago, when it explored two aspects of TikTok\u2019s operations in the EU: how it processed children\u2019s data, and how it transfers personal data to China. The DPC\u2019s decision on the second of these has not yet been released, but is expected sometime next year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Arrive at a ruling on how TikTok handles children\u2019s personal data wasn\u2019t straightforward. As the DPC explains, it submitted its draft decision to other EU data protection agencies a year ago. Two agencies \u2013 those based in Italy and Berlin \u2013 raised objections to the proposed decision. As with the <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/meta-gdpr-fine\/\">\u20ac1.2 billion fine<\/a> imposed on Meta earlier this year, this disagreement between EU agencies required the European Data Protection Board (EDPB) to adjudicate, which it has now done. The investigation concerned three aspects of TikTok\u2019s handling of children\u2019s private data:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Platform settings for children<\/li>\n\n\n\n<li>Age verification<\/li>\n\n\n\n<li>Transparency of information<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The DPC found that the profile settings for children\u2019s accounts were set to public by default, which meant that anyone on or off TikTok could view content posted by a child. The so-called <em>Family Pairing<\/em> setting allowed adults (who were not necessarily the child\u2019s parent or guardian) to pair their account with a child\u2019s account. This enabled adult users to send direct messages to children above the age of 16, posing \u201csevere risks to child users\u201d according to the DPC. Additionally, the fact that the profile settings for child users were set to public by default created further risks for children aged 13 or younger who gained access to TikTok.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As far as age verification was concerned, the final view was that TikTok had complied with the GDPR in its efforts to ensure that its platform was only available to those above the age of 13. The DPC also ruled that TikTok had implemented \u201c<a href=\"https:\/\/www.privateinternetaccess.com\/blog\/dark-patterns-how-tech-companies-use-interface-design-to-undermine-online-privacy\/\">dark patterns<\/a>\u201d that nudged users towards choosing more privacy-intrusive options during the registration process and when posting videos. While these UI issues have been around for a while, this is the first time a major ruling on the topic has been issued. The DPC also found that TikTok failed to provide sufficient transparency information to its child users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a result of the DPC investigation, and the EDPB\u2019s comments, the decision against TikTok involves three elements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A reprimand<\/li>\n\n\n\n<li>An order requiring TikTok to bring its processing of children\u2019s personal data into compliance with the GDPR within a period of three months from the date on which the DPC\u2019s decision was notified to the company<\/li>\n\n\n\n<li>Administrative fines totalling \u20ac345 million<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In response to the DPC decision, TikTok\u2019s Head of Privacy in Europe wrote: \u201cWe respectfully disagree with several aspects of the decision, particularly the level of the fine.\u201d The company\u2019s main argument is the following:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The DPC\u2019s investigation focused on the period between July and December 2020 only. The DPC did not find that TikTok\u2019s age assurance measures violated the GDPR, and most of the decision\u2019s criticisms are no longer relevant as a result of measures we introduced at the start of 2021 \u2013 several months before the investigation began.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s a rather weak excuse. It\u2019s like somebody saying it\u2019s true they were driving above the speed limit, but that later they slowed down, so they should be let off. The point is that for a certain period of time, TikTok did not comply with the relevant law (the GDPR).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s true that in the last year or so, TikTok realized that it needed to strengthen its privacy protection, not least because <a href=\"https:\/\/www.privateinternetaccess.com\/blog\/tiktok-bans-good-for-privacy\/\">bans<\/a> on using its services have been brought in around the world. In January 2023, TikTok\u2019s Global Head of Privacy &amp; Regulatory Affairs wrote a post entitled \u201cData Privacy Day 2023: Recognizing work done and what\u2019s next\u201d. It provided information about a number of initiatives aimed at strengthening privacy in the US and EU. These included establishing <a href=\"https:\/\/usds.tiktok.com\/usds-about\/\">TikTok US Data Security<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">an independent business entity tasked with managing all business functions that require access to user data identified by the US government as needing additional protection and safeguarding the systems that deliver content on the app in the US to ensure that it is free from foreign manipulation.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, on the other side of the Atlantic, TikTok established <a href=\"https:\/\/newsroom.tiktok.com\/en-ie\/irish-data-centre\">a data center in Dublin<\/a> to minimize data transfers outside the EU. More recently, this has been expanded as Project Clover:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">a program focused on creating a secure enclave for European TikTok user data. This initiative will introduce a number of new measures to strengthen existing protections and further align our overall approach to data governance with the principle of European data sovereignty.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">In response to continuing concerns about <a href=\"https:\/\/newsroom.tiktok.com\/en-us\/mythbusting-the-facts-on-reports-about-our-data-collection-practices\" rel=\"nofollow\">TikTok\u2019s privacy policies<\/a>, the company wrote a post called \u201cMythbusting: The Facts On Reports About Our Data Collection Practices\u201d in February 2023 and <a href=\"https:\/\/newsroom.tiktok.com\/en-us\/tiktok-truths-a-new-series-on-our-privacy-and-data-security-practices\">another<\/a> in June 2023 called \u201cTikTok Truths: A new series on our privacy and data security practices.\u201d Most recently, it has explained how it is complying with the new EU Digital Services Act, including the creation of a <a href=\"https:\/\/www.tiktok.com\/euonlinesafety\/en\/\" rel=\"nofollow\">European Online Safety Hub<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These high profile moves indicate how central protecting privacy has become to TikTok\u2019s services.
