The ECJ is the highest court in the European Union, and it issues preliminary rulings by a General Advocate about six months ahead of its final ruling. Today\u2019s preliminary ruling allows for mass surveillance on a state-by-state basis, but only when five conditions are met.<\/strong><\/p>\n<p>Two years ago, the ECJ struck down the detested <a href=\"https:\/\/en.wikipedia.org\/wiki\/Data_Retention_Directive\">Data Retention Directive<\/a> requiring all European member states to have mass surveillance of innocent people, blankly stating it wasn\u2019t fit for a democratic society, and even undid the existence of the directive retroactively. However, many European states had created such mass surveillance schemes in response to the directive, and the question was still open whether they were <em>allowed<\/em> to have such schemes, even if they were not <em>required<\/em> to.<\/p>\n<p>Therefore, this case has been closely watched by a lot of people: the 2014 case turned mass surveillance of innocent people from \u201cmandatory\u201d to \u201coptional\u201d for European states. This case had the potential to turn it back from \u201coptional\u201d to \u201cforbidden\u201d, as was the case before 2005. It was really important to get a clear yes or no from the court on the question whether mass surveillance of innocents can be acceptable, violating the presumption of innocence.<\/p>\n<p>The key point to why so many people are upset about this surveillance is that it\u2019s <em>pre-emptive<\/em> surveillance \u2013 people\u2019s privacy are being invaded <em>before<\/em> they have committed any crime at all, <em>in case<\/em> they would commit a crime later and that data would then be useful to a police investigation. Therefore, it is literally about mass surveillance of innocent people.<\/p>\n<p><strong>In a preliminary <a href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2014-02\/cp140020en.pdf\">ruling<\/a> today by the ECJ General Advocate, in answering the question of whether mass surveillance of innocent people is legal, the court laid down a firm \u201cmaybe\u201d.<\/strong><\/p>\n<p>The preliminary ruling \u2013 or \u201copinion\u201d, as it\u2019s formally called \u2013 states that data retention of innocent people may be permitted, as determined by the courts in each state, but only under very strict conditions. For example, it may never be used to prosecute trivial crimes or civil matters \u2013 only for serious crimes.<\/p>\n<p>The five conditions laid out by the General Advocate to allow data retention were;<\/p>\n<ol>\n<li><strong>Predictability.<\/strong> A mass surveillance of innocents must be very strictly described in law or regulation in a way that creates foreseeability, predictability, and protection from arbitrary interference.<\/li>\n<li><strong>Respect for privacy.<\/strong> A mass surveillance of innocents must respect the <em>essence<\/em> of the Charter of Fundamental Rights. The word \u201cessence\u201d is important here, as it literally requires a mass surveillance to abide by the spirit of the law and not the letter.<\/li>\n<li><strong>Serious crimes only.<\/strong> In balancing multiple competing interests, the preliminary ruling states that only the fight against <em>serious<\/em> crime is enough to warrant a general obligation to store data about everything and everybody. Convenience for investigations in general, or for expedience of criminal proceedings, or civil matters, is not enough.<\/li>\n<li><strong>No less intrusive method available.<\/strong> The General Advocate notes that mass surveillance of innocents is a very intrusive measure, and in order to be permitted, there must not exist any other method that provides the same effect with a lesser intrusion to privacy. Further, access to the stored data must be strictly limited to what is necessary to achieve the stated goal.<\/li>\n<li><strong>Proportionality.<\/strong> In the words of the General Advocate, this means that \u201cthe serious risks [!] engendered by [requiring mass surveillance] within a democratic society must not be disproportionate to the advantages it offers in the fight against serious crime\u201d.<\/li>\n<\/ol>\n<p>Following this preliminary ruling, we can expect the Hollywood lobby to assert that nonprofit sharing of culture and knowledge between private individuals should be a \u201cserious crime\u201d, on par with murder and arson. The copyright industry has been heavily dependent on Data Retention and other invasive measures that negate privacy to defend its position, and such a statement would hardly be the most surprising thing to come out of the copyright industry.<\/p>\n<p>The final ruling is expected in about six months, after which the legal challenges to individual state surveillance can commence.
