Prosecutors were granted a motion to compel two defendants to give up their smartphone\u00a0pin passcodes to search for evidence related to an extortion allegedly carried out by a couple, Victor and Voigt. The two devices in question are an iPhone and a Blackberry. The suspects\u2019 attorneys argued that passwords are protected as testimonial content by the Fifth Amendment of the US Constitution.<\/p>\n<h2>Judge rules that passcodes aren\u2019t protected by the Fifth Amendment<\/h2>\n<p>It used to be that you could be compelled to give up your fingerprint to unlock your phone, but not your password or pin passcode. <a href=\"https:\/\/www.extremetech.com\/mobile\/214874-court-rules-cell-phone-passcodes-protected-under-fifth-amendment\" target=\"_blank\" rel=\"noopener noreferrer\">Other cases<\/a>\u00a0involving smartphone passcodes\u00a0have set this precedent before.\u00a0This latest update to the ongoing battle for password privacy brings us further down the slippery slope to having no privacy on our devices.<\/p>\n<p>Kertch Conze, the\u00a0attorney for one of the defendants\u00a0ordered to furbish a password, Voigt,\u00a0<a href=\"https:\/\/www.cnn.com\/2017\/05\/03\/us\/miami-sextortion-phone-security-trnd\/index.html\">said<\/a>:<\/p>\n<blockquote><p>\u201cThey\u2019re asking for the passcode so they can keep on searching what\u2019s on the phone \u2013 which may be incriminating my client \u2014 and then use that against her.\u201d<\/p><\/blockquote>\n<p>Zlejka Bozanic, the attorney for the other defendant, Victor, said that her client didn\u2019t remember the password:<\/p>\n<blockquote><p>\u201cAt the end of the day, I know he won\u2019t be able to produce a password. You can\u2019t compel somebody to say something they don\u2019t have.\u201d<\/p><\/blockquote>\n<p>What happens next, we\u2019ll see. Just don\u2019t be surprised if it takes time and a Supreme Court ruling to set the privacy record straight. Josh Horowitz, a tech lawyer,\u00a0told CNN:<\/p>\n<blockquote><p>\u201cThis is definitely a question that is percolating in the lower courts and will eventually make its way up to the Supreme Court. Until it does, there\u2019s really no clear answer on this issue.\u201d<\/p><\/blockquote>\n<h2>The fight for constitutionally protected passcode and password privacy is right at the border<\/h2>\n<p>At the border, both citizens and non-citizens are being asked to give up passwords to social media accounts or access to devices or risk not being able to enter. The amount of such incidences has skyrocketed over the last year and public attention towards the subject is at an all time high.
