This week, the Colombian court <a href=\"https:\/\/sparcopen.org\/our-work\/r2rc\/\">acquitted him<\/a> of all charges.<\/p>\n<p>The Right-to-Research Coalition <a href=\"https:\/\/sparcopen.org\/our-work\/r2rc\/\">celebrates<\/a> the ruling, and says it points out the need to make it absolutely clear that the default must be \u201copen\u201d for research papers.<\/p>\n<p>This case is a result of changes to Colombian law in the wake of 2006 \u201cfree trade deals\u201d with the United States, when Colombia was obliged to turn up its copyright protection enforcement to 11 \u2013 much like the deals the US are trying to enforce elsewhere (see SOPA, ACTA, TPP, TTIP, TISA, etc). In this, just like elsewhere in the world, laws deviated sharply from public perception of justice: studies have shown that people have considerably less respect for copyright law than for speed limits on the highway.<\/p>\n<p>The Electronic Frontier Foundation <a href=\"https:\/\/www.eff.org\/deeplinks\/2014\/07\/colombian-student-faces-prison-charges-sharing-academic-article-online\">reported<\/a> on the case in 2014, and describes how freedom of expression and intellectual freedom suffer with severe prison sentences on the line for copyright infringement.<\/p>\n<blockquote><p>\u201cA graduate student is facing four to eight years in prison for sharing an academic article on the Internet. He wasn\u2019t making a personal profit from sharing the article \u2014 he simply intended for other scientists like him to be able to access and cite this scientific research.\u201d \u2014 EFF<\/p><\/blockquote>\n<p>The EFF quotes the Colombian <em>Fundaci\u00f3n Karisma<\/em>, who took on Gomez\u2019 case and explains how laws dictated mostly by Hollywood and the obsolete record industry are completely out of touch with today\u2019s perception of justice:<\/p>\n<blockquote><p>\u201cWithout prejudice to the pending debate on the subject, it should be clear that the actions of users, non-profit activities, and sharing, are not crimes.\u201d \u2014 EFF, Fundaci\u00f3n Karisma<\/p><\/blockquote>\n<p>Unfortunately, the case is not over: the prosecutor is expected to appeal the case to the Bogota Appeals Court.<\/p>\n<p>Privacy, as always, remains your own responsibility.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Three years ago, Colombian researcher Diego Gomez was charged with copyright infringement for uploading one (1) academic paper to Scribd, and was facing four to eight years in prison for the allegedly heinous act of sharing knowledge.
