...I am free to be indecent whether you like it or not.
No, Robert Lazar. Actually you're not "free to be indecent." There are
limits to the expression of indecency, both legal and practical.
On
a practical level you are now experiencing the suppression of your
indecencies here on this forum. That is entirely within the purview of
PIA. It's supported by the laws of man and the laws of nature. It's
called "property rights." This forum is PIA's property and by your use
of their property you are agreeing to comply with their rules. One of those rules is that you don't get to vandalize PIA's property with your filthy porn. If you
don't like their rules then don't use their property.
It's no
different than if you were to come into my house as my guest. As the
property owner it is my prerogative to establish house rules that
everyone must comply with, guests and family members alike. You don't
get to come into my house and put your muddy boots on my furniture. You
don't get to come into my house and help yourself to the food and
beverage in the frig. You don't get to come into my house and be indecent
with me or any of my family members, regardless of what you think your
alleged "rights" are. My right to be safe and secure in my property, and
my right to protect my family, trump any and all of your rights. PIA,
as the property owner of this forum, has the legal and practical
authority to enact any "house rules" it wants to.
As another practical example of your limitations on expression of indecency, were you ever indecent
toward any
of my children, it would be my prerogative to cave your face in and
break your arms and legs. This is supported by the laws where I live.
A bit of that "Wild Wild West" if you will, that you seem to admire. The
law would also then encourage me to file criminal charges against
you too, which you would face after you got out of the hospital.
Your so-called rights to indecency aren't supported by freedom of
speech anymore so than is vandalism a right of free speech. That's all you are -- a vandal. It's only yet more evidence of your own selfish sense of entitlement.
Pornography is still protected under the first amendment, just as guns are with the second,
Constitutional protections are not without limitations, and there are
countless examples of this. One has to apply something to the argument
that you appear devoid of -- common sense. The first rule to
understanding the Constitution is to understand why it was written and
who it was written to. It was written to restrain and limit the powers
of government. How does it even apply, therefore, to PIA -- a private
company? For the most part it doesn't.
You have the right to possess pornography, just as you have the right to possess a firearm, without interference from the government. The right of possession, however, does not transcend into a right to use it and carry it and display it in any way you arbitrarily determine.
For
example, while you have the right to possess a firearm, you don't have
the unlimited and unrestrained right to possess and carry it anywhere
you want. You can possess and carry a gun on your private property, such
as your home. But can you possess and carry it in your automobile, even
though that too is your private property? That depends on where you
live, and where you live also determines the conditions under which you
can possess it. Most states don't view it as your right
to physically carry your gun on your person in your automobile. Many
require you to have it unloaded and "out of reach," such as in the
trunk. Putting it loaded in the glove box will get you arrested and
criminally charged unless, that is, you're specifically licensed for it.
There are many other gun possession and carry restrictions too,
such as you cannot enter a public/government facility carrying a gun,
such as your local courthouse, or a public school. You also can't carry a
gun onto many private properties, such as banks, shopping malls and
stores, etc. The rights of private property owners trump your second
amendment rights.
The same thing applies to porn. You have a
right to possess porn. You don't have the right to carry it or display
it anywhere you please. The rights of other people to not have it pushed
in their faces trumps your own rights to display it.
This was all reviewed with our legal team and the section that referred to logging has been removed from our TOS. None of this has anything to do with CISA or any other law, government regulation, logging, etc.. PIA does not log VPN access.
The TOS update only applies to our forums and it's just the rules and regulations that we ask users to follow if they choose to use the forum. We applaud and encourage freedom of speech. We stand up for it and freedom of speech and privacy are the core principles behind PIA. However, there's a difference between freedom of speech and being down right disgusting to other users, clients, etc...
That type of behavior may have a place on the web but our forums are no longer the place for it. We're a strong community based on trust, privacy, freedom of speech, protection, etc... We want to encourage everyone to be creative and to both adopt and advance technologies that always protect our rights. However, discussions about rectums, pornographic images, photos of people masturbating, etc.. None of that has a place in PIA.
There are entire websites and communities dedicated to that.
