ISP Throttles my VPN?

I apologize if this has been asked before. I did a search and nothing came up.
Can your ISP throttle your speeds if you are on a VPN? I understand it's within their abilities, but I thought they would not see the traffic patterns they want to throttle in the first place if you were encrypted on a VPN.
In my case, I get a 70Mb/s pipe down, but it's almost rigid at 12Mb/s down when I open my torrent client.
What gives?
